New surveillance photos released in deadly officer-involved shooting at Walmart

- The Lenoir Police Department released new surveillance photos connected to an officer-involved shooting that occurred Tuesday morning. 

The incident happened at 8:23 a.m. Tuesday, August 16 at the Walmart located on Blowing Bouelvard. 

Upon arrival, officers said they came across three people identified as Carl Marcus Nivins, of Lenior, Natasha Rae Stanley, of Morganton, and Joe Alberto Flores, of Rhodhiss, NC, in connecttion to a possible vehicle break-in the Walmart parking lot. 

Upon approach, police said Nivins fled on foot. One Officer gave chase and another police officer staged at the entrance/exit near where Nivins was attempting to flee. As Nivins approached the exit, he retrieved a .38 caliber revolver from his waist band, turned toward the officers while running, and fired at least one shot. 

The officer giving chase was physically struggling with Nivins during this time trying to stop him. The officer staged at the entrance returned fire and struck Nivins. Nivins was pronounced dead at the scene. 

Other than minor injuries from the physical struggle, no officers were hurt and no other injuries were reported.

The Lenior Police Department said officers on the scene were equipped with Body Worn Cameras. The video and audio from these systems along with the surveillance video from Walmart confirm the evidence at the scene and paint a clear picture of what occurred.  

Both Stanley and Flores have been arrested on outstanding warrants from Burke County on unrelated charges: Stanley for Failure to Appear on Nonsupport and Flores for Felony Possession of a Firearm by Convicted Felon. 

Further charges related to this incident are expected.
