YORK, SC (WJZY) - No charges will be filed against a York High School bus driver after being involved in a fatal hit-and-run while taking children to school, according to York Police Dept.
77-year-old Carols Madariaga was walking along Lincoln Road on Wednesday, April 13, near the school, when he was hit.
Investigators told FOX 46 he died before first responders could get there to help him.
Police found pieces of a broken mirror at the crash scene which ultimately led them to the bus involved in the crash.
The evidence shows the bus driver was unaware that a side mirror on his bus hit Madariaga who was walking on the roadway in the direction of traffic on the white fog line early that morning, according to the 16th Circuit Solicitor's Office along with York Co. Police.
One student on the bus saw Madariaga, according to police.
“After a careful review of all the evidence in this case we are convinced that we could not prove that the driver was aware he struck Mr. Madariaga. This was a tragic accident”, said Solicitor Kevin Brackett.
