Pedestrian identified in east Charlotte fatal hit and run

- CMPD has identified the pedestrian who died after a fatal hit and run on Monday as Jose Rivera Gutierrez.

Officers responded to the 4900 block of Central Avenue in reference to a hit and run around 2:36 a.m.

When they arrived they found Gutierrez unresponsive in the median. He was pronounced dead by Medic.

CMPD says the hit and run vehicle left the scene on outbound Central Avenue towards North Sharon Amity Road.

Shortly after the crash Luis Fernado Perez-Rivera called 911 to report that someone had moved his van from its parking space at the 3000 block of North Sharon Amity Road. Officers showed up to Perez-Rivera's apartment and no one answered.

Officers found the Honda van with damage at the building next door. The van was taken to CMPD headquarters to be processed. Officers were able to get in contact with Perez-Rivera who agreed to come to CMPD to speck with detectives.

After speaking with detectives, Perez-Rivera was charged with driving while impaired, felony death by vehicle and felony hit and run.

Speed and alcohol impairment appear to be contributing factors in the crash, according to CMPD.

Gutierrez was crossing Central Avenue near the entrance to an apartment complex when he was hit and killed.

Police say the area was well lit and there was not a marked crosswalk present.
