Police: Homeowner wrestles suspect to floor in Alexander Co. home invasion

- The Alexander County Sheriff's Office is investigating a home invasion where the homeowners were able to restrain the suspect, according to deputies.

On Friday around 2:38 a.m. the sheriff's office received a call regarding the breaking and entering at Springfield Drive, Stony Point.

When deputies arrived they found Javier Martinez, 31, restrained to the floor by the owners of the home. Officers took Martinez into custody.

The homeowners told deputies that Martinez knocked on their door and told them he was stranded and needed to use a phone.

The homeowners gave a phone to Martinez and a short time later he gave it back and pulled a gun on them demanding entry into the home, according to deputies.

Once inside Martinez demanded money.

Deputies say the homeowner was able to grab Martinez and a struggle ensued, Martinez's gun discharged into the home but no one was hit and the homeowner was able to get the gun.

Martinez was charged with first degree burglary attempted robbery, possession of a firearm by a convicted felon, kidnapping and shooting into an occupied residence.

Bond was set at $250,000. A first appearance is set for Monday. The investigation is continuing and further charges are possible.
