CMPD fined by state after recruit's death, plans to challenge portions of report

North Carolina's Department of Labor Occupational Safety and Health Division recently conducted a workplace assessment following the death of police recruit Jeremy Moseley. 

As a result, the state fined the Charlotte-Mecklenburg Police Department a total of $7,000.00 for several violations regarding their Training Academy. 

According to the Department of Labor, on July 5, 2016 a heat stress awareness and prevention program was not implemented for employees/recruits while performing strenuous physical training.

They said employees/recruits were required to complete the physical training session in a high temperatures high humidity environment with no water provided, breaks not encouraged while wearing a bullet proof vest.  

The citation issued is NCGS 95-129(1): The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or were likely to causes death or serious injury or serious physical harm to his employees in that employees were exposed to external heat-related hazards associated with extreme physical training.

CMPD said they plan to challenge portions of the assessment and is submitting additional records to the Department of Labor referencing Moseley’s medical condition. 

The Medical Examiner determined that Moseley’s pre-existing medical condition played a critical role in his death. According to the Medical Examiner; Moseley collapsed while engaged in physical activity and that his medical history was significant for asthma.

The Medical Examiner also determined that Moseley had been taking herbal dietary medications. The autopsy examination revealed reactive airway disease and that based on his medical history and autopsy findings, the cause of  Moseley’s death was hyperthermia.

CMPD said they've reviewed and identified several changes to incorporate in to the department’s recruit training. 

These changes will assist the department in improving training practices.

Those changes include in part:

• The CMPD Academy training staff will be provided OSHA “Using the Heat Index: A Guide for Employers.  The guide will be reviewed by staff for a thorough understanding of employer responsibilities  under hot and humid conditions.
• The CMPD will begin to use a planning checklist provided by OSHA to brief recruits on the relevance of safety and health issues.
• The academy staff will immediately begin to monitor the OSHA safety phone application relevant to temperature and heat index.
• The CMPD will immediately begin to follow guidelines in OSHA’s publication specific to acclimating recruits to warmer temperatures and humidity.
• Water bottles are issued to each recruit and a five gallon water cooler is made accessible during physical training.
• Academy staff will be re-trained on the recognition of signs and symptoms of heat related illnesses.
